Service Terms & Conditions
1. Property Ownership & Authorization
By accepting this proposal, the Customer certifies that they are the legal owner of the property or have obtained written authorization from the property owner to authorize the work described herein. Customer agrees to indemnify and hold FieldCraft Forestry & Land Services harmless from any claims arising from a lack of ownership or authorization.
2. Site Readiness
Customer agrees to provide a safe and reasonably accessible work site before scheduled services begin.
Prior to arrival, the Customer is responsible for:
-
Removing trash, debris, wire, fencing, tires, metal, concrete, cables, and other foreign objects that may damage equipment.
-
Identifying and clearly marking irrigation systems, septic systems, drain fields, underground utilities, wells, invisible dog fences, survey markers, and any other concealed hazards.
-
Providing unobstructed access to the work area.
FieldCraft is not responsible for damage resulting from concealed or unmarked obstacles.
3. Trees, Structures & Areas to Remain
Any trees, vegetation, landscaping, structures, utilities, monuments, fences, or other items intended to remain must be clearly identified and physically marked by the Customer prior to work beginning.
FieldCraft is not responsible for unmarked items located within the work area.
4. Scope of Work
Services are limited exclusively to the work described in this proposal.
Any additional clearing, grading, hauling, trimming, debris removal, or other services requested before or during the project shall constitute a change in scope and may require additional pricing before work continues.
5. Customer Interruptions & Downtime
FieldCraft is committed to working efficiently and completing projects in a timely manner.
Customer requests requiring the operator to repeatedly stop work, relocate equipment, provide extended consultation, or perform work outside the agreed scope may result in billable downtime at the applicable hourly equipment rate.
6. Turf Disturbance & Ground Conditions
Forestry mulching equipment is heavy machinery and may cause rutting, tire or track impressions, soil displacement, or turf damage, particularly during wet conditions.
By accepting this proposal, Customer acknowledges that minor ground disturbance is an unavoidable part of performing the work and shall not be considered property damage.
7. Weather Delays
Work schedules are weather dependent.
FieldCraft reserves the right to delay, suspend, or reschedule services due to rain, saturated ground conditions, unsafe weather, equipment protection, or other circumstances beyond our control.
8. Payment Terms
Unless otherwise agreed in writing, payment is due immediately upon completion of the work.
Certain projects may require a deposit based upon project size or complexity. If required, the deposit shall be due upon equipment arrival at the job site and before work begins.
No deposit is required unless specifically stated within this proposal.
Past due balances may be subject to interest and collection costs as permitted by law.
9. Photographs & Marketing
Customer grants FieldCraft permission to photograph the project before, during, and after completion.
Photographs may be used for estimating, documentation, training, insurance purposes, website content, advertising, and social media. No personal identifying information or property address will be published without permission.
10. No Warranty on Vegetation Regrowth
Forestry mulching removes existing vegetation but does not prevent future regrowth.
FieldCraft makes no warranty or guarantee regarding future vegetation growth, invasive species, stump sprouting, seed germination, erosion, or changes resulting from weather or natural conditions.
11. Limitation of Liability
FieldCraft's liability for any claim arising from services performed shall be limited to the amount paid by the Customer for the specific services giving rise to the claim.
FieldCraft shall not be responsible for indirect, incidental, consequential, or speculative damages.
12. Right to Suspend or Stop Work
FieldCraft reserves the right to suspend or terminate work immediately if unsafe conditions are encountered, including but not limited to:
-
Aggressive animals
-
Hazardous terrain
-
Unmarked underground hazards
-
Dangerous weather
-
Unsafe customer conduct
-
Equipment-threatening conditions
-
Any circumstance that places personnel or equipment at unreasonable risk
13. Hidden Hazards
Customer is responsible for identifying and removing, or clearly marking, any known or suspected hazards within the work area that could damage equipment or create unsafe working conditions. This includes, but is not limited to, wire, cable, chain, fencing, posts, metal, concrete, rebar, rocks, abandoned equipment, stumps containing embedded objects, irrigation components, septic systems, wells, utility boxes, underground utilities, or any other concealed or partially concealed obstacle.
FieldCraft Forestry & Land Services is not responsible for delays, repairs, downtime, or equipment damage resulting from undisclosed, concealed, or unmarked hazards. Should equipment sustain damage due to such hazards, the Customer may be responsible for the associated repair costs, replacement parts, labor, lost production time, and any additional mobilization required to complete the project.
14. Equipment Access
Customer is responsible for ensuring adequate access for trucks, trailers, and equipment.
Additional labor, mobilization, recovery, or delays resulting from inaccessible conditions may result in additional charges.
15. Existing Property Conditions
FieldCraft is not responsible for existing damage or conditions present before work begins, including dead trees, leaning trees, unstable soil, erosion, drainage issues, deteriorated fences, or previously damaged improvements. Work performed may expose pre-existing conditions that were not visible before vegetation removal.
This is especially valuable because once brush is removed, customers sometimes discover old fence damage, erosion, junk piles, or other issues and mistakenly assume they were caused by the contractor.
I think this gives you a solid, professional set of terms that balances customer clarity with strong legal protection. Before relying on it for your business, it's worth having a Florida attorney review it to ensure it aligns with Florida law and your specific operations.
16. Acceptance
Acceptance of our proposal constitutes acceptance of these Terms & Conditions and forms a binding agreement between FieldCraft Forestry & Land Services and the Customer.
